DUI BLOOD TESTS

For blood testing in DUI cases, most Arizona law enforcement agencies use a technique called headspace gas chromotography.  That is a mouthful.  And the machine is as complicated as its name.  This machine mixes blood with various solutions places it in a vial, heats the vial, takes some of the air within the vial, burns it and then measures what comes out in the vapor.  It should also be noted that in DUI analysis, Arizona law enforcement agencies will typically run 30 or more vials of blood through the machine at one time!!! 

This is a complicated machine, performing complicated actions on many things at once and each action muct be performed with perfect accuracy or the entire result can be skewed.  The more complicated a machine, the more places that a problem can occur.  DUI prosecutors like to claim that these machines are accurate to within 5%.  As with breath testing, any unbiased expert or experienced DUI attorney will tell you that they are not nearly that accurate as they are used by Arizona Law enforcement in DUI cases and problems occur more often than the prosecution would have you believe.

The most common problem with the machines occur due to operator error.  Any minor error in the amount of blood or numerous other chemicals placed in a vial, and the results can be off my very large amounts.  In addition, if the viles are not handled delicately enough, or the machine is not perfectly calibrated at the time the test is run and the results will be unreliable.
